US Court Mandates Freedom of Abrego Garcia from Immigration Custody
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment lacks lawful basis.
"Since his return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.
The case originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an error. After his repatriation to the United States to face human smuggling charges, he was held in federal detention.
In her decision, the judge noted that the government lacks a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

The court challenge center on disputed assertions. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate criminal case in Tennessee.
