The NBA legend Testifies He Felt No Fear of the Racing Body in Antitrust Trial
Michael Jeffrey Jordan, as he cordially introduced himself in a federal courtroom on Friday, admitted that his drive to win and novelty within the sport motivated his effort with 23XI Racing to “challenge” Nascar over alleged violations of competition laws.
Team Investment and a Will to Win
The owner disclosed financial and corporate details of his 23XI team, revealing he invested $40 million of his own funds into the Cup Series operation co-founded with business partner Curtis Polk and driver Hamlin.
“Someone had to step forward,” Jordan said during testimony. “As a newcomer, I had no fear. I felt I could challenge Nascar as a whole. I felt as far as the sport it needed to be looked at from a different view.”
Central Issue: Charter Agreements and Renewal Demands
At issue is the expiration of a 2016 deal where Nascar granted each team a “charter”. The concept is similar to other major leagues with separately owned franchises, like the NBA’s Hornets or the NFL’s Panthers. This deal was set to expire in 2024 when Nascar insisted on charter membership renewals.
Jordan testified for an hour and exited the courthouse to pandemonium, with onlookers and reporters clamoring for a glimpse or a photo of the sports legend.
Leading the Legal Charge
Jordan’s 23XI is leading the full-court press along with another racing team for Nascar to overhaul a operating model Jordan contended is unlawful to keep two hands on the wheel.
For Jordan and and a fellow team representative, who preceded Jordan, are events from last September. Gibbs described a hectic and tense period where the racing circuit informed teams they had to sign a contract extension. The document consists of over a hundred pages detailing team compensation and a guaranteed entry in Nascar-sponsored races.
Choosing Litigation
Jordan explained that his team and its ally decided their sole viable path was to refuse a signature that 112-page package and take the issue to court. The other 13 organizations signed the agreement.
Jordan and co-owner Denny Hamlin reached out to Nascar about possible changes or extension options. Nascar refused to engage, according to his testimony.

Heather Gibbs’ Testimony
Gibbs described her push for indefinite franchises, submitted in a formal letter to Nascar. She said the pressure of the contract signing demand was problematic.
She said, Joe Gibbs first tried to call and talk Nascar out of demanding signatures, but CEO Jim France declined the request.
“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s executives. The response was, “Whether I have 20 charters, that’s what I have. If I have 30, I have 30.”
