Andrej Babiš, the self-styled billionaire who secured victory in last month's parliamentary vote, has declined to offload his extensive business interests, while insisting he will resolve a ethical dilemma that might prevent him from assuming the position of head of government.

Stance on Business Holdings

Babiš, whose ANO party came first in the October election but lacked a majority in parliament, stated in a social media post that he would not sell his Agrofert conglomerate, which operates in farming, food production, and chemical industries.

“I have consistently said I will not sell Agrofert. I have repeatedly stated I will address the ethical issue in compliance with Czech and European laws,” Babiš commented. “This is different from selling a roll in a bakery.”

President's Demand

The head of state, Petr Pavel, stated that the elderly political figure must clarify openly how he will remove conflicts of interest stemming from his corporate dealings before being appointed premier.

The Czech constitution “clearly mandates the head of state to take into account the potential occurrence of a ethical issue and the possibilities for its resolution” when selecting government ministers, the presidential administration noted.

The head of state “wants it to be clear in what precise manner Andrej Babiš will meet his statutory duties”, the announcement said, stating that Pavel was ready to appoint Babiš as premier “without delay” once the issue was settled.

Business Operations and Regulatory Concerns

Babiš's numerous companies, primarily under the Agrofert umbrella, operate in the nation and other central European states, receiving substantial funds in domestic and European farming and other grants, as well as government deals.

Under national legislation, government ministers are barred from obtaining public aid or agreements. The ethics organization Transparency International has stated that to prevent a conflict of interest, Babiš must either divest, decline government deals, or not enter public office.

Previous Tenure and Present Plans

Babiš said he would “follow the laws” if appointed as premier, but declined to explain how in beforehand because the matter was “an highly personal and personal matter for me, and journalists will always criticise me anyway”.

During his initial tenure as premier, from 2017 to 2021, Babiš faced several legal battles and an EU investigation over potential conflicts of interest. He placed his holdings into trust funds, while keeping some influence over them.

A court and the EU executive both ruled that this was insufficient. Babiš confirmed last month that he was once more the exclusive proprietor of Agrofert and insisted he was “taking steps” to avoid a conflict of interest, but declined to disclose details.

Governing Agreement and Foreign Policy Consequences

The billionaire populist has signed a governing pact with two minor right-leaning groups, the ultra-conservative, Russia-friendly SPD, which has advocated a referendum on leaving the EU, and the Motorists for Themselves, which has primarily campaigned against the EU’s environmental policy.

The incoming administration, if approved, is expected to bolster the populist movement in the region and might challenge backing from Western nations for Ukraine – even though Babiš has contacted Ukraine’s president, Volodymyr Zelenskyy, to confirm of the nation's backing.

Pavel, who as head of state has a role for foreign policy, also demanded that the government agenda include a statement on the official stance on the conflict in Ukraine, including a commitment to meeting alliance duties.

The head of state has earlier said he would not approve any ministerial nominees who might doubt the nation's EU and Nato commitments, a condition that the ultra-conservative party has said it will meet by proposing independent technocrats.
